These terms govern orders placed with AGR GAMING LTD trading as Arcade Geeks. Please read them before placing an order.
Key points
Every machine is built to the Buyer’s selected specification and is not an off-the-shelf product.
Usual estimates are 1–3 weeks UK and 2–3 weeks EU. Complex, themed or peak-period orders may take up to 12 weeks.
Qualifying domestic machines include parts-only return-to-base cover subject to the dedicated warranty terms.
Customers must confirm dimensions, delivery access, specifications and artwork before ordering.
Buyer means the individual or organisation buying or agreeing to buy Goods from the Supplier.
Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession.
Business Buyer means any Buyer who is not a Consumer.
Contract means the contract for sale of Goods incorporating these Terms and any written terms agreed by the Supplier.
Goods means arcade machines, parts, accessories and related products ordered from the Supplier.
Supplier means AGR GAMING LTD, company number 17165232, trading as Arcade Geeks.
Website means www.arcadegeeks.co.uk.
2.1 These Terms apply to all Contracts for sale of Goods by the Supplier and prevail over Buyer documentation unless the Supplier agrees otherwise in writing.
2.2 An order is an offer to purchase. A Contract forms only when the Supplier accepts the order.
2.3 Any variation is effective only when agreed in writing by the Supplier.
2.4 The Buyer must provide complete and accurate billing, delivery, contact, specification and consumer/business-status information.
3.1 All machines are made to the Buyer’s selected specification. The Buyer is responsible for checking cabinet type, dimensions, access, artwork, controls, colours, trim, games system and upgrades before ordering or approving a proof.
3.2 Approved artwork and specifications form part of the Contract. Later changes are not guaranteed and may cause additional cost or delay.
3.3 If Goods become unavailable, the Supplier may offer an equivalent component, a revised specification, a wait, or cancellation where appropriate. Any material substitution will be discussed with the Buyer.
3.4 Multiple orders are processed separately unless agreed otherwise.
4.1 Prices appear on the Website. Delivery and other charges are shown before checkout where applicable. Payment is due in full when ordering unless agreed otherwise in writing.
4.2 The Supplier may pause production, withhold delivery or cancel an order if payment is declined, reversed or not received when due.
4.3 Klarna or third-party finance refunds and adjustments are normally processed through the relevant provider.
4.4 A chargeback, payment dispute, reversal or provisional refund does not by itself cancel the Contract or determine the parties’ legal rights.
4.5 The Supplier may provide the payment provider, card issuer, finance provider, insurer or other authorised party with relevant evidence, including accepted terms, payment and order details, specifications, communications, production records, delivery evidence and information concerning possession, condition or use of the Goods.
4.6 Legal title remains with the Supplier until the full price and applicable charges are received in cleared funds. If payment is later reversed and no valid legal remedy applies, the amount remains due; the Buyer may not retain both the Goods and reversed payment.
4.7 Where an amount remains lawfully outstanding, the Supplier may require payment or return of the Goods. Until resolved, the Buyer must take reasonable care of the Goods and must not deliberately damage, sell, dispose of or transfer them.
4.8 If payment or return is refused, the Supplier may pursue lawful civil recovery, including recoverable interest, court fees and costs. The Supplier will not enter private property or recover Goods without consent or lawful authority.
5.1 The usual estimated UK mainland turnaround is approximately 1–3 weeks. The usual estimated EU turnaround is approximately 2–3 weeks.
5.2 Complex, heavily customised or themed orders, and orders placed during busy or peak periods, may take up to 12 weeks from acceptance.
5.3 By ordering, the Buyer accepts that the extended period may apply. The absence of a separate update does not shorten the applicable period. Progress updates are available on reasonable request.
5.4 Dates are estimates, not guarantees. Events beyond reasonable control, courier or customs delay, failed delivery, customer-requested changes and access problems may extend them.
5.5 Goods can only be delivered to the delivery address supplied at the point of purchase. The Buyer must check that the address is complete and accurate before submitting the order. The delivery address cannot be changed after the order has been placed. The Buyer must provide a suitable recipient and safe access. Reasonable redelivery and storage charges may apply where delivery fails due to the Buyer.
5.6 Standard machines are delivered to the front door. Elite pallet deliveries are kerbside only. Drivers are not authorised to take Goods indoors or upstairs. The Buyer is responsible for checking access and arranging assistance.
5.7 Risk passes when Goods are physically delivered to the Buyer or their nominated recipient. Title is governed by clause 4.6.
6.1 Goods are custom-made to the Buyer’s specification. There is no change-of-mind return right for customised or personalised Goods. A cancellation request before production begins may be considered only at the Supplier’s discretion and may be subject to reasonable costs already incurred. Once production begins, cancellation is not accepted.
6.2 The Buyer must inspect delivery promptly. Visible damage, missing items or delivery issues should be reported within 48 hours with photographs of all outer and inner packaging, legible shipping labels, the complete Goods and the reported damage. All packaging must be retained while the claim is assessed.
6.3 Late reporting, discarded packaging or incomplete evidence may prevent the Supplier from establishing transit damage and may affect the claim outcome.
6.4 Reporting a problem does not automatically establish a manufacturing fault or refund entitlement. The Supplier may require reasonable diagnostics, system information, photographs, video, component return or inspection before deciding whether a qualifying fault exists.
6.5 Where a qualifying fault is confirmed, the remedy depends on the circumstances and applicable law. Repair or replacement may precede a refund where permitted.
6.6 No return may be made without written authorisation. Goods must be safely packaged and include the order number. Damage caused by misuse, poor storage, unauthorised alteration, inadequate return packaging or failure to follow instructions is the Buyer’s responsibility.
6.7 Any acceptance of a custom-made item as a goodwill return is discretionary. The Supplier may deduct reasonable handling, packaging, inspection, administration, transport and loss-in-value costs.
7.1 For consumers, the Supplier is responsible for losses that are a foreseeable result of its breach of contract or failure to use reasonable care and skill. The Supplier is not responsible for losses that were not foreseeable, for business losses incurred by a consumer, or for losses caused by information, access or action the Buyer failed to provide.
7.2 For business Buyers, to the fullest extent permitted by law, the Supplier’s total contractual liability arising from an order will not exceed the price paid for the affected Goods. The Supplier is not liable to a business Buyer for loss of profit, revenue, business, anticipated savings, goodwill, data or any indirect or consequential loss.
7.3 The Supplier does not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of title, or any liability that cannot lawfully be excluded or limited.
8.1 Delay or failure to enforce a right is not a waiver of that right.
8.2 The Supplier is not responsible for delay or failure caused by circumstances beyond its reasonable control.
8.3 If any provision is invalid or unenforceable, it is severed only to the necessary extent and the remaining provisions continue.
9.1 The Supplier may update these Terms for future orders. Changes do not retrospectively alter a Contract already concluded.
9.2 These Terms and the Contract are governed by the law of England and Wales. Subject to mandatory Consumer rights, the courts of England and Wales have jurisdiction.
10.1 Buyer status depends on whether the purchase is wholly or mainly personal or wholly or mainly related to a trade, business, craft or profession.
10.2 A business name, commercial delivery address, order quantity, correspondence, installation environment and intended use may be considered when determining status. These are evidence only. Status depends principally on whether the Buyer entered the contract wholly or mainly for private purposes or in the course of business.
10.3 The Buyer confirms that information about intended use and status is accurate. The Supplier may reject or defend a consumer-status claim where evidence indicates business use or misleading information.
10.4 Consumer-only cancellation and rejection rights do not apply to a Business Buyer. Business remedies are limited to these Terms and any express written warranty, subject to law.
10.5 Business Buyers have no change-of-mind return right. The Supplier may choose remote support, parts, repair, replacement, refund or price adjustment as appropriate.
10.6 The promotional domestic warranty does not cover commercial, organisational, educational, hospitality, public, rental, revenue-generating, customer-facing or workplace use unless agreed in writing.
11.1 A machine sold as new may contain up to two professionally tested refurbished internal components, including a PCB, screen or equivalent internal part, where this is disclosed before purchase. Those components are covered on the same basis and for the same applicable remaining warranty period as other covered hardware.
11.2 Refurbished components are tested before installation and intended to meet appropriate functional standards.
11.3 Refurbished components in a qualifying domestic machine are covered by the applicable parts warranty.
12.1 Qualifying machines include a five-year parts warranty comprising a one-year manufacturer’s warranty and four-year extended promotional warranty, subject to the dedicated warranty terms in force at purchase.
12.2 Cover is non-transferable and limited to the original mainland-UK purchaser using the machine privately at home. Commercial and non-domestic use is excluded unless agreed in writing.
12.3 Covered components may include buttons, joysticks, microswitches, PSU, monitor, speakers and games-board or PC hardware. Software, configuration, third-party accessories, misuse, accidental damage, consumables and cosmetic wear are excluded.
12.4 For a claim made solely under the voluntary warranty, the customer normally pays to return the requested part. This does not apply where applicable law requires the Supplier to bear return costs under a statutory remedy. An approved replacement may be new or refurbished and carries the original component’s remaining warranty. Once a replacement is supplied, the replaced original becomes the Supplier’s property. An original supplied against an advance replacement must be returned within 14 days or the replacement cost may be charged.
12.5 Tampering, unauthorised modification or repair, misuse, unsuitable placement, environmental damage and commercial use may void affected cover.
